比赛名称
1. 澳式橄榄球AFL微博门票比赛(“比赛”)是由澳大利亚联邦政府通过澳大利亚驻华大使馆(“大使馆”)举办的比赛。


比赛期间
2. 比赛将从2019年5月10日18:00 CST(GMT +8)开始,至2019年5月23日12:00 CST (GMT +8)终止。
资格
3. 比赛无参赛费并向以下人士开放:
a. 年满18岁及以上的中国公民(以参赛日期为准)
4. 大使馆或其附属机构的员工、承包商及/或其直系亲属无参赛资格。直系亲属是指配偶、实际伴侣、子女、孙子女、父母、祖父母及/或兄弟姐妹(及其配偶)。
5. 大使馆保留核实每个参赛者的参赛资格的权利,并有权拒绝任何不符合参赛资格要求的参赛者参加比赛及/或免除其参赛资格。通过参加比赛,参赛者保证其有资格参赛。


参加比赛
6. 参加比赛的每个参赛者必需在比赛期间:
a. 带上话题#遇见澳大利亚#转发评论@澳大利亚驻华使领馆的原提问微博并回答问题:“你和朋友观看过最难忘的体育赛事是什么?”
7. 每个参赛者仅有一次参赛机会。


内容标准
8. 为使参赛作品有效并获得评判资格,参赛作品必需达到以下内容标准:
a. 参赛作品必需是参赛者原创的作品,不得复制或包含任何第三方的材料及/或未经允许使用的内容。如果大使馆有理由相信参赛作品不是参赛者个人的原创作品或以其他方式违反了本条款与条件,则大使馆有权不评判该作品并取消其参赛资格。


评判规则
9. 参赛作品将由大使馆工作人员按照以下标准评判:
a. 一等奖获得者将从转发贴点赞达到十个及以上的粉丝中选出
b. 二等奖获得者将通过@微博抽奖平台 从转发粉丝中随机选出
10. 如大使馆判断某一参赛作品涉嫌欺诈行为,例如同一人士通过虚假电子邮箱地址或虚假微博账号获得多次参赛资格,或以任何其他非法行为获得相较于其他参赛者的优势,该参赛作品将丧失参赛资格。


比赛奖品
11. 一等奖获得者(共两名)将获得2019年6月2日(星期日)AFL澳式橄榄球超级联赛上海站的门票。二等奖获得者(共十名)将获得礼包一个。
12. 奖品将以其“原状”授予,不承担任何保证责任,且不可转让或折现。如果原始奖品无法获得,大使馆保留以其他类似价值的奖品替代原始奖品的权利。
13. 除非本条款与条件另有规定,与颁奖、授奖、接收或使用奖品有关的任何费用,包括因兑换奖品产生的旅行费用,大使馆概不负责。


获奖通知及领奖
14. 比赛结束后,大使馆将通过发布大使馆微博并@比赛获奖者,以此公布获奖者。
15. 大使馆还将在比赛结果公布后两个工作日内通过微博私信通知获奖人。此时,大使馆将收集获奖人的详细信息(姓名及年龄)及联络信息,以安排领奖事宜。获奖人必须在收到大使馆的请求后两个工作日内提供个人信息和联络信息。
16. 居住在上海之外地区的符合条件的获奖人将有资格获得最高3,000人民币的旅行补贴。
17. 居住在中国其他地区的获奖人需自行安排去上海的交通和住宿。获奖人自己负责购买适当的旅行保险。
18. 只有居住在上海以外地区的获奖人有资格获得旅行补贴。获奖人必需向大使馆提供前往及离开上海的火车/飞机票以及与观看AFL赛事有关的酒店住宿票据,以获得每位最高3,000人民币的报销款。跨城市交通及上海住宿之外的费用不在报销范围之内。如大使馆有任何理由相信该请求不真实,大使馆保留拒绝报销请求的权利。
19. 获奖人必须在微博发布AFL比赛的照片,并@大使馆官方账号,以获得报销资格。
20. 如果获奖人未能在要求的时间内向大使馆提供其个人信息和联络信息,或未能根据第16、17、18、19条的规定领取奖品,获奖人将自动放弃奖品,并且大使馆保留根据本条款与条件另行选择获奖人的权利。


知识产权
21. 参赛者保证其参赛作品不是从任何其他作品复制、再创作或衍变而来,且其作品不侵犯任何第三方的任何其他合法知识产权或隐私权利。 参赛者将赔偿大使馆并使其免于任何因使用参赛者的参赛作品而被第三方提起的任何申索,包括但不限于指控侵犯或违反该第三方的知识产权或隐私权利。
22. 参赛者授予大使馆非排他、无使用费、在世界范围内、不可撤销、不可转让的永久性许可,许可其在任何媒体、任何时间、为任何目的整体或部分使用、变更、复制、删除、增加、公开展示及/或再现参赛者的参赛作品。
23. 参赛者授予大使馆在不支付额外对价的前提下为推广之目的使用其个人信息、肖像、评论及/或参赛作品的权利,除非法律禁止。包括但不限于在大使馆微博页面或网站宣布比赛结果、公布获奖人姓名。


隐私
24. 与参赛作品及/或赢得比赛有关的个人信息(包括但不限于参赛者的姓名)将被大使馆为推广、营销及宣传比赛之目的收集、使用及披露(包括通过微博)。大使馆会将所有个人资料储存在安全的电子数据库中,使用完毕后将予以销毁。若参赛者未向大使馆提交信息,则无法参加比赛。有关大使馆如何处理个人信息的具体问题,请点击网站查阅我们的隐私政策:http://dfat.gov.au/about-us/about-this-website/pages/privacy.aspx。
25. 参赛者应知悉,大使馆在其官方微博中公开的个人信息仅用于与本次比赛相关的推广、营销和宣传目的,微博并非本次比赛的赞助商、代言人或管理方,与本次比赛绝没有任何关联。参赛者应参考微博的隐私政策,以进一步了解微博如何处理参赛者个人信息。参赛者还应知悉,在同意大使馆向包括微博在内的外部接受方公开其个人信息后,如果微博违反了澳大利亚隐私原则,1988年《隐私法案》的责任承担条款不适用于大使馆,且索赔条款不适用于参赛者。


免责
26. 参赛者同意不追究并免除大使馆和微博的任何法律责任,使大使馆和微博免于因在参赛者参赛过程、验收过程和奖品使用或误用过程中,直接或间接导致的部分或所有损害、亏损或伤害。
27. 大使馆对于第三方刊登、发布、上传、分享、传播的信息以及通过社交媒体服务传播的内容不承担任何责任。对于社交媒体网站或互联网上发布的任何材料,由于传播、准确性或完整性引起的任何问题大使馆概不负责。对于因使用社交媒体服务提供的信息而产生的任何损失或损害,大使馆不承担任何责任。


修订和取消
28. 大使馆保留对任何条款、条件进行更改、修订、删除或补充的绝对酌情处理权,且无需事先通知。若参赛者继续参加比赛,即表示参赛者接受所有修订的条款及条件。参赛者应定期查看大使馆网站,以及时了解条款和条件是否有任何变更。如参赛者不同意更改,他/她可通过私信退出比赛。
29. 大使馆保留以任何理由取消、终止、修改或暂停比赛的权利,且不承担说明具体原因的义务。如果比赛被取消、终止、更改或暂停,大使馆有绝对酌情权选择不颁发任何与比赛有关的奖品。大使馆有权决定取消、终止、修改或暂停比赛,且无须对任何参赛者支付任何性质的赔偿。
30. 使馆保留本次比赛的最终解释权。
31. 大使馆有关任何竞赛方面的决定为均最终决定,对所有参赛者具有约束力。不会进行通信联系。
32. 条款与条件以中英双语书就。如有任何差异,以英文版本为准。


管辖法律
33. 该比赛受中国法律管辖。

 

 

TERMS AND CONDITIONS OF ENTRY


IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THE COMPETITION.

Competition Name
1. The AFL Weibo Ticket Competition (the Competition) is a competition run by the Commonwealth of Australia through the Australian Embassy in Beijing (the Embassy).
Competition Period
2. The Competition will run from 18:00 CST (GMT +8) on 10 May 2019 to 12:00 CST (GMT +8) on 23 May 2019.

Eligibility
3. Entry into the Competition is free and is open to:
a. Chinese citizens aged 18 years and over (as of date of entry)
4. Employees of the Embassy or its attached agencies, its contractors and/or their immediate family members are ineligible to enter the Competition. Immediate family member means a spouse, defacto partner, child, grandchild, parent, grandparent and/or sibling (and their spouses).
5. The Embassy reserves the right to verify the eligibility of each Entrant and to exclude and/or disqualify any Entrant who does not meet the eligibility requirements. By entering the Competition, the Entrant warrants that he or she is eligible.

Entering the Competition
6. To enter the Competition each Entrant must, during the Competition Period:
a. describe the most memorable sports match they have watched with friends in a repost of the Embassy’s original post announcing the Competition.
7. Each Entrant is only permitted to enter the Competition once.

Content Criteria
8. For an entry to be considered valid and eligible for judging it must meet the following content criteria:
a. Your entry must be your own work, must not be copied, or contain any third-party materials and/or content that you do not have permission to use. If the Embassy has reason to believe your entry is not your own work or otherwise breaches the Terms and Conditions, then the Embassy may not consider it and may disqualify it.

Judging Criteria
9. Entries will be judged by Embassy staff on the following criteria:
a. 1st prize winners will be picked from reposts with 10 or more likes, based on the quality of the answers as judged by the Embassy;
b.  2nd prize winners will be selected using Weibo's randomised lucky draw system.
10. Entries which the Embassy determines have involved fraudulent practices, such as false email addresses or fake Weibo accounts to allow multiple entries by the same person, or any other illegitimate behaviour to gain advantage over other entrants, will be disqualified from the Competition.

Competition Prize(s)
11. 1st prize winners (2 in total) on Weibo will be each given two AFL tickets to attend the match in Shanghai on Sunday 2 June 2019. 2nd prize winners (10 in total) will each receive a small gift bag.
12. The Prize is given "as is" without any warranty, and is not transferable or exchangeable for cash. The Embassy reserves the right to substitute the Prize with another prize of similar value if the original prize is not available.
13. Unless otherwise specified in these terms and conditions, the Embassy will not be responsible for any costs associated with the award, acceptance, receipt or use of the Prize, including any cost of travelling to redeem the Prize.
Notification and collection of Prize
14. The Embassy will announce the winner of the Competition by tagging them on a post on the Embassy’s Weibo after the end of the Competition Period.
15. The Embassy will also notify the winner by private message on Weibo within two business days of announcing the result. At this time, the Embassy will seek the winner’s details (name and age) and contact details, to organise collection of the Prize. The winner must provide the Personal Details and contact details within two business days of the request by the Embassy.
16. Winners residing outside Shanghai are eligible to be reimbursed for up to 3,000.00 RMB travel allowance, if conditions are met.
17. Winners are liable to organise their own transport and accommodation for Shanghai if residing elsewhere in China. It is the winner’s responsibility to take out appropriate travel insurance.
18. Only those residing outside Shanghai are eligible for the travel allowance. You must provide receipts for train/flight tickets to and from Shanghai, and receipts for hotel accommodation associated with attending the AFL game to the Embassy for a reimbursement of up to 3,000.00 RMB per winner. Costs other than inter-city travel and accommodation in Shanghai are not covered. The Embassy reserves the right to reject any reimbursement request if there are any reasons for us to believe the claims are not genuine. 
19. Winners must post photos of the AFL match on Weibo and tag the Embassy’s official account to be eligible for the reimbursement.
20. If the winner fails to provide the Embassy with his or her Personal Details and contact details within the required timeframe, or fails to collect the Prize in accordance with paragraphs 16, 17, 18 and 19, the winner will forfeit the Prize and the Embassy reserves the right to select another winner, in accordance with these terms and conditions.

Intellectual property
21. The Entrant warrants that his or her entry has not been copied, recreated, reproduced or derived from any other work and that the entry does not infringe on any other legal, intellectual property or privacy rights of any third party. The Entrant indemnifies and holds harmless the Embassy from any and all claims by any third party arising out of the use of the Entrant’s entry, including but not limited to claims of infringement or violation of the intellectual property or privacy rights of the third party.
22. The Entrant grants the Embassy a non-exclusive, royalty-free, worldwide, irrevocable, non-transferable, perpetual licence to use, modify, copy, delete from, add to, publicly display and/or reproduce, the Entrant’s entry, in whole or in part, in any medium, now or at any time in the future for any purpose.
23. The Entrant grants the Embassy the right to use his or her Personal details, likeness, comments and/or entry for promotional purposes without payment of additional consideration, except where prohibited by law. This includes but is not limited to announcing the result of the Competition and publishing the name of the winner on the Embassy’s Weibo page or website.

Privacy
24. Personal information associated with the entry and/or winning of the Competition (including, but not limited to, the Entrant’s name) will be collected, used and disclosed (including to Weibo) by the Embassy for promotional, marketing and publicity purposes in connection with the Competition. This personal information will be stored by the Embassy on a secure electronic database and will be destroyed once it is no longer required for these purposes. If this information is not collected, the Embassy will be unable to enter the Entrant into the Competition. For further information regarding how the Embassy will handle this information, please consult our Privacy Policy at: http://dfat.gov.au/about-us/about-this-website/pages/privacy.aspx .
25. The Entrant acknowledges that while the Embassy will disclose this information to Weibo for promotional, marketing and publicity purposes in connection with the Competition, the Competition is in no way sponsored, endorsed or administered by, or associated with, Weibo. The Entrant should refer to Weibo’s own privacy policy for further information as to how Weibo will handle the Entrant’s personal information. The Entrant also acknowledges that by agreeing to the Embassy disclosing their personal information to overseas recipients including Weibo, if Weibo  breaches the Australian Privacy Principles, the Embassy will not be accountable under the Privacy Act 1988 (Cth) and the Entrant will not be able to seek redress under that Act.

Indemnities
26. The Entrant agrees to indemnify, release and hold harmless the Embassy and Weibo from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from the Entrant’s participation in the Competition and the acceptance, use or misuse of any Prize that may be won.
27. The Embassy is not responsible for content that third parties publish, post, upload, distribute, disseminate or otherwise transmit via social media services. The Embassy accepts no liability whatsoever arising from or connected to the currency, accuracy or completeness of any material posted on social media sites or elsewhere on the internet and disclaims all responsibility for any loss or damage which may arise from the use of information provided via social media services.

Amendments and cancellation
28. The Embassy reserves the right to, at its absolute discretion and without prior notice, vary, amend, delete or supplement any of these terms and conditions and the Entrant’s continued participation in the Competition amounts to acceptance of any revised terms and conditions. The Entrant should check the Embassy’s website on a regular basis for any changes to these terms and conditions. If an Entrant does not agree to a change, he or she may withdraw from the Competition by direct messaging.
29. The Embassy reserves the right to, for any reason and without any obligation to state a particular reason, cancel, terminate, modify or suspend the Competition. In the event of such cancellation, termination, modification or suspension, the Embassy may at its absolute discretion elect not to award any Prize in respect of the Competition. The decision of the Embassy to cancel, terminate, modify or suspend the Competition will not give rise to any liability to pay compensation of any nature to any Entrants.
30. The Embassy reserves the right of final explanations of this competition.
31. The Embassy’s decision in relation to any aspect of the Competition is final and binding on every Entrant. No correspondence will be entered into.
32. These Terms and Conditions are written in both Chinese and English. Should any discrepancies arise, the English version shall prevail.

Governing law
33. The Competition is governed by the laws of China.
